1.1. ผู้ใช้งานตกลงที่จะปฏิบัติและผูกพันตามเงื่อนไขการใช้บริการแอปพลิเคชัน ซึ่งการใช้บริการของผู้ใช้งานถือเป็นการยอมรับเงื่อนไขการให้บริการนี้ โดยไทยวิวัฒน์อาจเปลี่ยนแปลงเงื่อนไขการใช้บริการได้ไม่ว่าในเวลาใด และจะแสดงเงื่อนไขที่เปลี่ยนแปลงเพื่อให้ผู้ใช้งานได้รับทราบและยอมรับเงื่อนไขใหม่ก่อนการเริ่มต้นใช้งานแอปพลิเคชัน ซึ่งหากผู้ใช้งานกดปุ่ม “ตกลง” ยอมรับเงื่อนไข ย่อมถือเป็นการยอมรับการแก้ไขในครั้งนั้นๆ

1.2. ผู้ใช้งานยอมรับว่าไทยวิวัฒน์มีสิทธิในการดำเนินการแก้ไข เพิ่มเติม หรือปรับปรุงเปลี่ยนแปลงบริการได้ ซึ่งบางครั้งผู้ใช้งานอาจต้องอัปเดตแอปพลิเคชัน หรือติดตั้งแอปพลิเคชันใหม่ และการที่ผู้ใช้งานใช้บริการต่อหลังจากที่มีการอัปเดตแอปพลิเคชัน หรือติดตั้งแอปพลิเคชันใหม่ ย่อมถือเป็นการยอมรับการแก้ไข เพิ่มเติม หรือปรับปรุงเปลี่ยนแปลงในแต่ละครั้ง

1.3. หากผู้ใช้งานมีการให้ข้อมูลส่วนบุคคลแก่ไทยวิวัฒน์ ผู้ใช้งานยินยอมให้ไทยวิวัฒน์ เข้าถึงข้อมูลส่วนบุคคลที่ได้ให้ไว้ เช่น ชื่อ นามสกุล หมายเลขประจำตัวประชาชน หมายเลขโทรศัพท์ อีเมลหรือข้อมูลอื่นๆ ที่เกี่ยวข้อง และยินยอมให้บริษัทเข้าถึงข้อมูลส่วนบุคคลดังกล่าวได้เพื่อวัตถุประสงค์ในการให้บริการด้านการประกันภัย ทางการตลาด นำเสนอบริการและผลิตภัณฑ์ใหม่ๆ การติดต่อสื่อสาร และอื่นๆ โดยบริษัทจะเก็บรักษาข้อมูลส่วนบุคคลที่ผู้ใช้งานได้ใช้งานหรือได้ให้ข้อมูลผ่านแอปพลิเคชัน และจะไม่เปิดเผยไปยังบุคคลภายนอก โดยมิได้รับความยินยอมจากผู้ใช้งานก่อน เว้นแต่เป็นไปตามกฎหมาย คำสั่งของหน่วยงานราชการ ศาล หรือเจ้าหน้าที่ที่มีอำนาจตามกฎหมาย หรือเพื่อความจำเป็นใดๆ เพื่อให้ผู้ใช้งานสามารถใช้บริการ Application ได้ ตามวัตถุประสงค์แห่งข้อตกลงนี้ หรือเป็นการอันจำเป็นเพื่อให้ไทยวิวัฒน์ปฏิบัติตามสัญญาประกันภัย ทั้งนี้ผู้ใช้งานยังคงมีสิทธิตามกฎหมายในข้อมูลส่วนบุคคลที่ได้ให้ไว้แก่ไทยวิวัฒน์

1.4. ผู้ใช้งานยอมรับว่าแอปพลิเคชันบนระบบปฏิบัติการ iOS และ Android จำเป็นต้องอ้างอิงการให้บริการของ App Store (สำหรับผู้ใช้งานระบบปฏิบัติการ iOS) และ Google Play (สำหรับผู้ใช้งานระบบปฏิบัติการ Android) ทั้งในรูปแบบเงื่อนไขในปัจจุบันและอนาคตที่อาจเกิดการเปลี่ยนแปลง และอาจทำให้การให้บริการบางเวอร์ชันของระบบปฏิบัติการไม่รองรับการใช้งานของแอปพลิเคชัน และทำให้ผู้ใช้งานที่ใช้อุปกรณ์ชนิดใดๆ ที่มีเวอร์ชันของระบบปฏิบัติการ iOS และ Android ที่ไม่รองรับต่อการใช้งานไม่สามารถใช้บริการของแอปพลิเคชันได้

1.5. ผู้ใช้งานยินยอมและยืนยันในการให้ข้อมูลที่ถูกต้อง ครบถ้วนและเป็นจริงทุกประการต่อไทยวิวัฒน์ผ่านการใช้บริการโดยแอปพลิเคชันนี้ และผู้ใช้งานจะแจ้งให้ไทยวิวัฒน์ทราบหากมีการเปลี่ยนแปลงข้อมูล

1.6. ไทยวิวัฒน์ขอสงวนสิทธิ์ในการเสนอบริการ ผลิตภัณฑ์ใหม่ๆ แก้ไขเปลี่ยนแปลงผลิตภัณฑ์ ข้อความหรือเนื้อหาบน แอปพลิเคชัน โดยมิต้องบอกกล่าวล่วงหน้า

2.1. แอปพลิเคชันนี้สามารถใช้ได้บนอุปกรณ์เคลื่อนที่แบบสมาร์ตโฟน (Smart Phone) หรืออุปกรณ์เคลื่อนที่แบบแท็บเล็ต (Tablet) โดยอุปกรณ์ที่ใช้ระบบปฏิบัติการ iOS จะรองรับเวอร์ชัน 10.0 เป็นต้นไป และระบบปฏิบัติการ Android รองรับเวอร์ชัน 6.0 เป็นต้นไป

2.2. ผู้ใช้งานจะต้องเป็นผู้รับผิดชอบในการจัดหาอุปกรณ์เคลื่อนที่แบบสมาร์ตโฟน (Smart Phone) อุปกรณ์สื่อสาร ระบบปฏิบัติการและการเชื่อมต่อที่จำเป็นสำหรับการใช้บริการ โดยผู้ใช้งานเป็นผู้รับผิดชอบค่าใช้จ่ายที่เกี่ยวเนื่องดังกล่าวด้วยตนเอง

2.3. ผู้ใช้งานจะต้องเก็บรักษารหัสผ่าน และข้อมูลที่ใช้ในการสมัครใช้บริการไว้เป็นความลับเฉพาะตัวของผู้ใช้งานเท่านั้น และไม่เปิดเผย หรือกระทำการใด ๆ ที่อาจทำให้ผู้อื่นทราบรหัสผ่าน และ/หรือข้อมูลดังกล่าว ผู้ใช้งานยอมรับว่าหากมีการกระทำการใด ๆ โดยใช้รหัสผ่านของผู้ใช้งาน ให้ถือเป็นการกระทำโดยผู้ใช้งานเองทุกประการ และไทยวิวัฒน์ไม่ต้องรับผิดชอบในความเสียหายที่เกิดขึ้นจากการใช้รหัสผ่านดังกล่าว

ในการติดตั้ง การเข้าถึง และการใช้งานแอปพลิเคชัน ท่านไม่มีสิทธิดำเนินการอย่างใดอย่างหนึ่งหรือทั้งหมด ดังนี้

3.1. แอบอ้างข้อมูลอันเป็นเท็จเพื่อการแสดงตัวตนในการเปิดใช้บริการ

3.2. ทำซ้ำ และ/หรือสำเนา เปลี่ยนแปลงแก้ไข แสดงผล ส่งข้อมูล จัดเก็บข้อมูล แพร่กระจาย จัดพิมพ์ พัฒนาขึ้นใหม่ หรืออ้างอิงแหล่งข้อมูลอันผิดต่อกฏหมายแห่งราชอาณาจักรไทย ผิดต่อพระราชบัญญัติว่าด้วยการกระทำผิดเกี่ยวกับระบบคอมพิวเตอร์ รวมถึงข้อมูลที่เกี่ยวกับการเจาะระบบ (Hacker/Cracker) ข้อมูลที่เกี่ยวกับการแอบอ้างข้อมูลทางบัตรเครดิต (Phishing) ข้อมูลที่ผู้ใช้งานไม่ใช่เจ้าของสิทธิ์ หรือข้อมูลลักษณะที่ก่อให้เกิดความเสียหายต่อผู้อื่น ไม่ว่าทั้งหมดหรือบางส่วน

ไทยวิวัฒน์จะไม่รับผิดชอบสำหรับความสูญเสีย เสียหาย ขัดข้อง ล่าช้า หรือ สิ่งอื่นใด อันเกิดจากเหตุสุดวิสัยหรือเหตุใด ๆ ที่อยู่นอกเหนือการควบคุมของไทยวิวัฒน์

5.1. ข้อมูลทั้งหมดที่ปรากฎในแอปพลิเคชันนี้ อาทิ ข้อความ รูปภาพ ตารางข้อมูล กราฟ โลโก้ กราฟิก เสียง การออกแบบหน้าจอแอปพลิเคชัน การออกแบบส่วนต่อประสานกับผู้ใช้งาน (Interface) ข้อมูลต่างๆ ไม่ว่าจะอยู่ในรูปแบบใด โปรแกรมซอฟต์แวร์ใดๆ ที่มีอยู่ในแอปพลิเคชันนี้ (รวมเรียกว่า “เนื้อหา”) เป็นสิทธิของไทยวิวัฒน์ ซึ่งเนื้อหาเหล่านี้ได้รับความคุ้มครองด้านทรัพย์สินทางปัญญา และ/หรือสิทธิในความเป็นเจ้าของอื่นๆ ตามกฎหมายของประเทศไทย ไม่ว่าจะได้รับการจดทะเบียนไว้หรือไม่ก็ตาม และท่านมีสิทธิเพียงเข้าดู ใช้บริการ เพื่อประโยชน์ส่วนตัวเท่านั้น

5.2. ผู้ใช้งานจะต้องไม่ใช้ชื่อทางการค้า เครื่องหมายการค้า เครื่องหมายการบริการ ตราสัญลักษณ์ ชื่อโดเมนของไทยวิวัฒน์ โดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรจากไทยวิวัฒน์

5.3. ผู้ใช้งานจะไม่ทำซ้ำ ข้อมูลใดๆ หรือคัดลอกส่วนหนึ่งส่วนใดของ Application หรือกระทำด้วยประการวิธีใดๆ โดยนำเอาไปใช้เพื่อประโยชน์ในทางการค้า หรือเพื่อประโยชน์ใดๆ ของตนเองหรือของบุคคลภายนอก

6.1. การใช้บริการแอปพลิเคชันนี้หรือการตีความข้อตกลงและเงื่อนไขการใช้บริการแอปพลิเคชันนี้ให้เป็นไปตามกฎหมายไทย หากมีข้อพิพาทไทยวิวัฒน์และผู้ใช้งานตกลงจะใช้เขตอำนาจศาลไทย

ผู้ใช้งานรับรองว่าผู้ใช้งานเป็นผู้มีความสามารถตามกฎหมาย หรือได้รับความยินยอมตามกฎหมายในการผูกพันตามเงื่อนไขการให้บริการฉบับนี้ และผู้ใช้งานเข้าใจดีว่าผู้ใช้งานต้องรับผิดชอบต่อผลใดที่เกิดขึ้น หรืออาจเกิดขึ้นอันเนื่องมาจากการใช้บริการที่ผู้ใช้งานเป็นผู้กระทํา หรืออนุญาตให้บุคคลที่สามใช้ข้อมูลการลงทะเบียน รหัสผ่าน หรือข้อมูลอื่นใดของผู้ใช้งาน

Term and Condition นี้เป็นเพียงเงื่อนไขการใช้งาน Application เท่านั้น หากมีกรณีเกิดข้อสงสัยหรือข้อโต้แย้งใดๆ เกี่ยวด้วยสัญญาประกันภัย ผู้ใช้งานรับทราบว่าเงื่อนไข ข้อตกลง ข้อยกเว้นตามกรมธรรม์ประกันภัยยังคงเป็นไปและมีผลสภาพบังคับตามเงื่อนไขกรมธรรม์ประกันภัยในแต่ละประเภท

1.1. Users are bounded and abided by terms and conditions of the application when using it. Thaivivat reserves the right to change and modify these terms and conditions at any time. Users will be informed of any changes and are required to acknowledge and accept those changes before using the application. By clicking "accept" each time means that users have agreed to be bounded and abide by the change of those terms and conditions.
Withdrawal consent: Users can withdraw any consent. But users agree and acknowledges effects and all inconvenience while using Thaivivat Application . And may be the reason for Thaivivat not being able to comply with the contract with users. And Thaivivat could collect user ’s data by the Rules or any Laws and Regulations

1.2. Users have accepted that Thaivivat reserves the right to change, revise, modify, add, or improve such services, which will require updates, or reinstallation of the application. Application usage after every update or reinstallation means that users have acknowledged and accepted to those changes, modifications, and improvements of the application.

1.3. In case users have given Thaivivat their personal information. Users have allowed Thaivivat to access their given information such as full name, ID number, Telephone number, E-mail or other related information, and agreed to permit usages of such information for insurance services, marketing, new products and services offering, contacting users, and others. All personal information, given by users or application usage, will be kept by the company and will not be disclos to third parties without consent 's users except it is stated by the law, government's order, court, officials with legal power, or any essential needs. In order for users to use this application by purposes stipulated in this agreement. However,users are entitled to all rights of their personal information given to Thaivivat.

1.4. Users agreed that usage of application on IOS and Android operating system requires Apple Store services (for IOS) and Google Play services (for Android), which their terms and conditions may differ in the future. Further versions of operating systems may be unsupportive to the application. In this case, users will not be able to access the application.

1.5. Users are consent and agreed to verify accurate data or truthly information to Thivivat through application usage. And will inform Thaivivat if there is any information change.

1.6. Thaivivat reserves the right to offer new products and services, change, revise and modify product or context on the application without prior notice.

2.1. This application can be used on smart phones, tablets with IOS operating system version 10.0 onwards and android operating system version 6.0 onwards.

2.2. Users are responsible for the provision of devices and operating system that are supportive to the application, which the costs are all users’ responsibility.

2.3. Users must keep password and registered information to themselves, do not disclose or conduct any certain actions that would lead to disclosure of such information. Users have agreed that if any actions are done by users’ account (using users’ password), such action will be considered conducted by users themselves and Thaivivat is not responsible for any damages caused by such action.

In installing, accessing, and using applications. Users are not permitted to do any of the followings:

3.1. Impersonating or using falsified information for registration.

3.2 Duplicate and / or copies, modify, change, display, send data, store data, distribute, publish, develop or referring using sources that are against the law of the Kingdom of Thailand, against computer-related crime Act including hacking/cracking information such as credit card phishing, information that users are not entitled to or information that could cause damages to others whether in whole or in part.

Thaivivat is not responsible for loss, damage, delay or any other failures caused accidentally or by situations that are beyond Thaivivat’s controlling capability.

5.1. All information displayed in this application such as text, images, data tables, graphs, logos, graphics, sounds, application screen designs, design of users’ interface. Any information (regardless of format, software program) contained in this application (which is called "Content") are entitled to Thaivivat. These contents are protected by intellectual property rights and/or other ownership rights according to the law of Thailand. Whether they were registered or not. Users can only access, see and utilize.

5.2. Users must not use trade name, trademark, service mark, logos, and domain name of Thaivivat without the written consent of Thaivivat

5.3. Users must not duplicate any information, or copy any parts of the application, or conduct actions that refers to commercial benefits, their own benefits or third-party benefits.

6.1 Usage of this application or interpretation of these terms and conditions is in accordance with the law of Thailand. If there is any disputes, Thaivivat and users agree to use Thai jurisdiction.

6.2 Computer- related Crime Act B.E. 2560

6.3 Cyber Security Act B.E. 2562

6.4 Personal Data Protection Act B.E. 2562.

Users guarantee that users are consent and legal, or obtained legal consent to be bounded with these terms and conditions. And users clearly acknowledge that users are responsible for consequences of application usages, information usages done by users or others using users’ account.

This Term and Condition is only applicable for application usage. In case there’re any queries or arguments about insurance contract. Users acknowledge that the terms, conditions, and exclusions under the insurance policies are still effective and enforceable in accordance with insurance policies in each insurance type.
